What Is the Retail Worker Safety Act?
Signed into law on September 4, 2024, the RWSA (S8358B/A8947C) requires New York retail employers to implement:
- Workplace violence prevention policies
- Employee training
- Emergency alert systems for large retailers (by 2027)

Who Needs to Comply?
Retail employers in New York State with 10 or more employees:
- Applies to: Any retail business selling consumer goods
- Does not apply to: Food service, government agencies, or public authorities
Does this Apply to Me?
The New York Retail Worker Safety Act (RWSA) applies to all retail employers operating within New York State that have at least 10 employees working at a retail store, regardless of where the company is headquartered. This means that even if a retailer is based outside of New York, if it operates retail locations within the state and meets the employee threshold, it must comply with the RWSA requirements.
Key Requirements & Deadlines
Written Safety Policy – Effective June 2, 2025
- Covers late shifts, cash handling, and reporting procedures
- Must be provided in English and your employees’ primary languages
Interactive Training – Effective June 2, 2025
- Includes de-escalation, emergency response, and site-specific safety
Emergency Alert Systems – Effective January 1, 2027
- Required for retailers with 500+ employees in New York State
- Must connect directly to emergency services
Ongoing Training & Notices
- Written notice of policy upon hire and annually (in your employees’ primary language)
- Training schedule: 10-49 employees:
- Upon hire + every 2 years
- 50+ employees: Upon hire + annually
