New attorney-authored course helps supervisors recognize potential leave situations early, respond appropriately, and involve HR before compliance risks escalate.

Chatham, New Jersey — Supervisors are often the first to hear when an employee may need protected leave. But employees rarely use legal terminology, and many workplace conversations that trigger Family and Medical Leave Act (FMLA) obligations don’t begin with a formal leave request.

Instead, an employee mentions an upcoming surgery. Someone shares they’re caring for a parent with a serious health condition. Another casually explains that recurring migraines have made getting to work more difficult.

While HR administers the formal leave process, supervisors are often responsible for recognizing these early signals. Missing them—or responding inappropriately—can create compliance risk, employee relations challenges, costly disputes, and, in certain circumstances, individual supervisor liability under the FMLA.

That’s why SHIFT HR Compliance Training developed Understanding the Family and Medical Leave Act (FMLA), a new supervisor-focused training course designed to help managers recognize potential leave situations, respond appropriately, and involve HR before routine workplace conversations become compliance issues.

“As organizations continue to navigate increasingly complex workplace issues, supervisors need more than policy awareness,” said Katherin Nukk-Freeman, Co-Founder and President of SHIFT HR Compliance Training. “The biggest FMLA mistakes rarely happen after HR receives a leave request. They happen during the everyday conversations where supervisors don’t realize legal obligations may already be emerging. That’s why we developed this course.”

Preparing supervisors for the conversations that matter

Unlike traditional FMLA training that focuses primarily on eligibility requirements and leave administration, the course prepares supervisors for the practical decisions they make every day.

Through realistic workplace scenarios, managers practice recognizing conversations that may involve protected leave, responding professionally to employee concerns, avoiding common compliance pitfalls, and knowing when HR involvement is appropriate.

Managers will learn how to:

  • Recognize workplace conversations that may signal a need for protected leave.
  • Identify leave-related situations, even when employees never mention FMLA.
  • Respond appropriately while avoiding common compliance mistakes.
  • Understand what supervisors should and should not ask.
  • Know when and how to involve HR.
  • Navigate attendance, performance, and leave-related conversations with greater confidence.

Developed and reviewed by employment law attorneys who have defended employers in FMLA claims, the course reflects the real workplace situations supervisors encounter throughout the employee lifecycle.

A different approach to FMLA training

Most FMLA training teaches supervisors what the law requires. SHIFT prepares supervisors for the moments when they need to apply sound judgment.

Rather than teaching supervisors to administer leave, the course focuses on recognizing situations that may require additional attention, responding appropriately, and partnering with HR before small issues become larger compliance concerns.

“Compliance doesn’t begin when paperwork reaches HR,” said Nukk-Freeman. “It begins with the decisions supervisors make every day. When supervisors recognize concerns early, respond thoughtfully, and know when to involve HR, organizations are better positioned to support employees, reduce compliance risk, and create more consistent workplace practices.”

The course reflects SHIFT’s approach to compliance training: preparing employees and managers to make better workplace decisions before, during, and after the moments that matter most. Whether responding to a potential accommodation request, recognizing a possible need for protected leave, addressing workplace misconduct, or navigating another complex employment issue, better outcomes begin with better decisions.
